These are a cross-section of the many questions that we have frequently been asked. There is no other aspect of law in which the law as a formal construct, and case law as the practical application of it, diverge so strikingly: According to Austrian law, for example, parents are obliged to pay their children what is described as a “reasonable maintenance”. However, what is actually considered “reasonable” in individual cases, is reflected in the kaleidoscope of practical interpretations as is evident in thousands (!) of different decisions that have been worked out by case law. Consequently, there is a plethora of legal literature which is specialised on child maintenance. Further, it is important to bear in mind that there is no legal provision in Austrian law for the reimbursement of costs entailed in legal proceedings concerning maintenance claims of a minor child. In other words, each party must bear the costs of their own legal representation, regardless of the outcome of the proceedings.
