While Austrian law explicitly makes provision for a separate legal procedure in which the property law aspects of a previously married couple are clarified following a divorce, this does not apply to cohabiting partners. They are in effect "strangers" to each other within the meaning of the Austrian law. It is therefore strongly recommended that, in the case of a long-term cohabitation in which for example, both partners make investments (with future dividends) or consciously forego income on the premise of sharing their future; a contract is concluded in which provision is explicitly made for the "worst-case scenario" - the end of the cohabitation. Questions such as the abovementioned sample must then be promptly and proficiently answered, preferably by a seasoned family lawyer who can provide legal guidance and representation as well as drawing up a legally binding and tailored contract.
