Securing (or contesting) claims
When going about securing claims, time is indeed of the essence! As securing claims may take several years to enforce in court, a seasoned practicing lawyer such as RA Dr. Nademleinsky may in effect secure or alternately, effectively contest, a so-called "interim injunction". One of the most important injunctions in financial matters of family law is for example that an interim maintenance is to be paid by one spouse or a divorced spouse to the other spouse (§ 382 Z 8 lit a EO). What makes this kind of injunction particularly interesting is the fact that this regulation order may concern not only the necessary maintenance, but an interim appropriate maintenance. Similarly, the temporary regulation of the use or the temporary securing of marital property and marital savings in connection with proceedings for the division of these assets or in connection with proceedings for divorce, annulment or declaration of nullity of the marriage, may be ordered. In these cases, pertinent features of enforcement law are applicable to the proceedings.
