Divorce & Separation
Given the technical possibilities to cultivate global contacts and the demands on mobility of today's world, international family law questions are constantly arising:
- Which countries are able to make decisions on international family law cases like international divorce or cross-border support?
- What laws apply to international family law / cross-border cases?
- Are foreign judgments recognized in Austria; concomitantly are Austrian decisions recognised abroad?
- Must belongings and assets be divided in an international divorce?
- Which countries support (and enforce) which decisions in cross-border international family law cases?
- What happens to the children?
As early as 2007, based on what had even then become both practical experience and increasingly complex theoretical consideration of these matters Dr. Nademleinsky was able to focus specifically on these topics: together with Prof. Dr. M. Neumayr, Vice-President of the OGH, he wrote the book "International Family Law"; a comprehensive but also practical book which covers all aspects of International Family Law. The third edition of the book was published in 2022.
This book catalysed International Family Law as an own field of study and proferred subject at the University of Vienna. Since then, Dr. Nademleinsky has not only been an Attorney-at-Law with his own successful practice specialised exclusively in Family Law and International Family Law, he has also written many more books and publications, his expertise and practical experience in this field being well received by both lawyers and judges worldwide.
As both a vastly experienced Attorney-at-Law who has practised exclusively in (International) Family Law from the very beginning of his career, and an internationally recognised leading expert in International Family Law, what Dr. Nademleinsky could do for you (subject to availibility, as he personally takes care of his clients) would be:
- Representation in international divorce proceedings
- Representation in international asset division
- Enforcement or defence of international maintenance claims
- Drafting of internationally valid marriage contracts
- Advice on international adoptions
- Representation concerning international contact laws and care procedures
- Representation in cases of child abduction
